3. Eligibility
To use our services, you must be at least 18 years of age and capable of entering into legally binding agreements.
If you are creating a film about another person, whether living or deceased, you affirm that you have full legal rights and permissions to share any materials and stories provided to us for production.
4. Services Provided
Celebrating Life Movies provides custom video production and storytelling services designed to create personal “legacy films” based on client-provided materials, interviews, and creative direction.
Our services are entirely custom and creative in nature. Each project is unique and cannot be resold, replicated, or reassigned. We do not offer general media editing services outside this framework.
All projects are produced according to the terms defined in the client’s individual service agreement.
5. Client Responsibilities
By submitting materials or purchasing our services, you agree to the following:
- You will provide accurate and truthful information regarding your project.
- You own or have full legal permission to use all materials you provide (photos, videos, writings, music, etc.).
- You will not submit content that is defamatory, obscene, unlawful, or infringes on another person’s rights.
- You will cooperate with our production process by providing requested materials and feedback within reasonable timeframes.
- You understand that delays in communication or submission may extend project timelines.
6. Ownership and Intellectual Property
- All original materials you provide remain your property.
- The final edited film remains the intellectual property of 8th Dimension LLC until full payment is received. Upon payment in full, you are granted personal, non-commercial usage rights to your finished film.
- You may share, display, and distribute your completed film privately among family, friends, and personal audiences.
- Commercial use (e.g., public exhibition, broadcast, or resale) requires separate written permission from 8th Dimension LLC.
- 8th Dimension LLC retains the right to store an archival copy for internal records, quality assurance, or future authorized reproduction.
- We will never use, publish, or display your film or materials publicly without your explicit written consent.
7. Payment Terms
- All projects require full payment in advance before production begins.
- Payments are non-refundable once production has started, as all work is custom and time-sensitive.
- Refunds and cancellations are governed by our Refund & Return Policy, which is incorporated into these Terms by reference.
- Unauthorized chargebacks or disputes after production has begun may result in legal collection measures and additional fees.
8. Project Timelines
Each film is unique. Estimated timelines will be stated in your individual service agreement and may vary depending on scope, length, and complexity.
While we strive to meet estimated delivery dates, timelines are not guaranteed. Factors such as client response time, volume of media, and technical restoration needs may affect turnaround.
Delays caused by the client (e.g., late submission of materials or revisions) will extend delivery deadlines without penalty to 8th Dimension LLC.
9. Revisions and Delivery
- The number of included revisions will be outlined in your project agreement.
- Revisions cover small adjustments (sequencing, captions, or timing). Substantial re-edits or new creative direction requests may incur additional charges.
- All films are delivered digitally unless physical media is specifically purchased or agreed upon.
- Once the final film has been delivered and no revisions are requested within the agreed window, the project is considered accepted and complete.
10. Confidentiality and Data Protection
Confidentiality is at the core of our work.
- All personal information, communications, and media you provide are treated as strictly confidential.
- We do not share, sell, reproduce, or use your media for any purpose beyond your film unless you give written consent.
- All digital files are stored securely, and physical media is handled with professional care and returned after use.

11. Limitation of Liability
To the fullest extent permitted by law:
- 8th Dimension LLC is not liable for loss, damage, or corruption of client-provided media during transit, digitization, or production, though we exercise the highest care in handling.
- We are not responsible for copyright issues arising from client-provided content.
- We are not liable for project delays due to events beyond our control, including illness, equipment failure, natural disasters, or client non-responsiveness.
- The total liability of 8th Dimension LLC for any claim shall not exceed the total amount paid by the client for the specific project.
12. Consent for Public Display
By default, all projects are private.
No film, clip, or excerpt will be shared publicly or used for marketing without your express, written authorization.
If you choose to make your film public, we will confirm and document your permission in writing before any use.
13. Termination of Service
We reserve the right to refuse or terminate service at our discretion, including if:
- The client provides unlawful, offensive, or infringing materials.
- The client engages in abusive, dishonest, or disruptive behavior.
- The project is determined to be outside the scope of our services.
If a project is terminated prior to production, a partial refund may be issued at our discretion. Once production has begun, refunds are not available.
14. Indemnification
You agree to indemnify and hold harmless 8th Dimension LLC, its owners, employees, contractors, and affiliates from any claims, damages, or expenses resulting from:
- Materials you provide,
- Your breach of these Terms, or
- Any third-party claims related to your content or use of our services.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, USA.
Any disputes or claims arising from these Terms or our services will be handled through binding arbitration or small claims court in Tarrant County, Texas, unless otherwise required by law.
16. Changes to These Terms
We may update these Terms periodically to reflect changes in business practices or legal requirements.
The latest version will always be posted on our website with a revised “Last Updated” date.
Continued use of our services constitutes acceptance of the most recent Terms.
